Dealing with the ongoing impact of historical family violence in parenting matters

Join us in a panel discussion exploring the manner in which we, as practitioners, and the Courts can effectively and usefully deal with historical domestic and family violence in parenting proceedings. We will be joined by:
- Judge Demack, Federal Circuit and Family Court of Australia (Division 2)
- Tom FitzGerald, Family Consultant and Social Worker
- Shannon Daykin, Accredited Family Law Specialist, Legal Practitioner Director of Daykin Family Law
- Belinda Cox, Team Leader Safer Community Culture, Brisbane Domestic Violence Service, Micah Projects
As part of the discussion, we will cover how historic family violence might be dealt with in parenting cases where there is cogent evidence that a party (the aggrieved) has been the victim of violence, the aggrieved has been traumatised by that violence and continues to experience trauma, including in circumstances where there is arguably a benefit to the child in having a meaningful relationship with both parents. We will cover issues relating to gatekeeping behaviours, how the Egg Shell Skull Rule might impact thinking and the intersection between a child’s needs and the needs of their carers, and how as practitioners we can respond to these issues.
