Family violence in Hague Convention matters

The Hon Justice Jenny Hogan will moderate a panel discussion of experienced practitioners including Murray Green, Lisa Foley and Nicole Fitzgibbon.
The Commonwealth Government amended the relevant Regulations in December 2022 to provide that family violence can be considered by a Court when deciding whether to return a child under the Hague Convention. The panel will address questions around family violence and the Hague Convention, including:
- whether the recent changes effect any substantial impact on the law;
- how family violence is taken into account in return applications;
- the trends in respect of family violence in return applications, and more.
Justice Hogan was appointed Queen’s Counsel in 2012 and as a Justice of the Brisbane Registry of the Family Court of Australia in 2013. Murray Green of Counsel has appeared as a solicitor and barrister in numerous Hague Convention matters over the past three decades. Lisa Foley has acted as solicitor for many clients in Hague Convention matters, including the highly publicised “Italian Sisters” matter in 2012. Nicole Fitzgibbon is a Special Counsel at McInnes Wilson, and acts for the State Central Authority when return applications are brought in Queensland.
